Terms of service

1. Scope
Our General Terms and Conditions, which can be accessed on the Internet, apply to all our orders in our online shop.

All offers and promotions in advertising material and in the online shop are only valid while stocks last. We ask for your understanding that the delivery is only in normal household quantities. All prices are in euros including the applicable statutory value-added tax and plus a proportion of shipping costs. The amount of the shipping costs can be found under point 8 of the terms and conditions or on our website www.dotwork-design.com

 

2. Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the last goods.

In order to exercise your right of withdrawal, you must inform us (dot.Work eU, Moosfelderstraße 51, 4030 Linz, Tel. +43 699 10448688, email: order@dotwork-design.com, www.dotwork-design.com) by means of a clear statement (e.g. a letter sent by post or an e-mail) about your decision to withdraw from this contract. You can use the attached sample revocation form for this, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation

If you revoke this contract, we have paid you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract.

 

For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You have to send the goods back to us immediately and in any case, at the latest within fourteen days from the day on which you informed us about the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.

The buyer bears the costs of the return.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods. End of revocation.

 

3. Expiration of the right of withdrawal
A right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer, and it expires prematurely in the case of contracts for the delivery of sealed goods which, for reasons of health protection or hygiene, are not suitable for return if their seal has been removed after delivery.

4. Voluntary return guarantee
For all purchases from the dot.Work range, we grant you a voluntary return guarantee of a total of 30 days from receipt of the goods in addition to the statutory right of withdrawal. You can also withdraw from the contract after the 14-day cancellation period has expired by sending the goods back to us within 30 days of receipt (beginning of the period on the day after receipt of the goods), provided the goods are complete and in their original packaging and are in unused and undamaged condition condition and it is not a matter of goods that are specially made to customer specifications or are clearly tailored to personal needs. Timely dispatch is sufficient to meet the deadline. The goods are to be returned to: Retoure dot.Work e.U., Moosfelderstraße 51, 4030 Linz/Austria.

The contractually granted voluntary return guarantee does not affect your legal rights and claims. In particular, your statutory right of withdrawal and your statutory warranty rights remain unrestricted.

5. Contract language
The contract, order and business language is German or English.

6. Orders and Deliveries
Deliveries are generally possible within the European Union and rest of world. Delivery is only in normal household quantities.

7. Validity of prices
The prices stated on www.dotwork-design.com are online prices in euros (including statutory VAT).

8. Shipping costs per order and delivery address, regardless of the order value
We charge a one-time shipping fee for each package delivery depending on the delivery address. In the case of a partial shipment, the flat rate is charged only once.

 

8.1. Staggered shipping costs
2,50 Euro within Austria
4,50 Euro within european union and
10,00 Euro rest of world

We only charge 10.00 euros for specially marked items that are delivered by a forwarding agent because of their bulkiness or weight (forwarding articles), and we take care of the rest. The forwarding agent delivers the items to the customer to the point of use.

9. Payment
In principle, you can pay in advance, by credit card, PayPal, PayPal Express or on account or monthly statement. In no case is it possible to deduct a cash discount.

We reserve the right to offer you only certain payment methods for the requested delivery, for example to secure our credit risk only those according to the respective creditworthiness.

In individual cases, we reserve the right to deliver the goods only after a deposit has been paid. After receipt of the order, we will coordinate this with the customer.

10. Retention of title
The goods remain our property until full payment has been made.

11. Electronic communication
You agree that the contract-related communication can take place in electronic form.

12. Alternative Dispute Resolution
We are not obliged and not willing to participate in dispute settlement procedures before a consumer arbitration board.

13. Privacy
Data protection is very important to us. The responsible body within the meaning of the GDPR is dot.Work e.U., Moosfelderstraße 51, 4030 Linz. You can find information about your rights, among other things, at www.dotwork-design.com

14. Receiving promotional messages
You expressly agree that your name, your date of birth, your address and, if you register for the newsletter, your e-mail address and telephone number will be forwarded to the following cooperation partners and you agree to this, both from us and from those listed below cooperation partners to receive information material for advertising purposes (e.g. newsletter, product or service information, etc.) by post, SMS, telephone call or e-mail. You can revoke this consent at any time. In this case, please email our customer service office@dotwork-design.com.

15. Right to information, correction, blocking and deletion of stored data
You have the right to free information, correction, blocking and deletion of your stored data at any time. You can contact us in this matter in writing by e-mail at office@dotwork-design.com or by post to the company location given in the imprint. This right is only limited insofar as we can suspend the deletion to protect our claims.

16. Image rights
All image rights are owned by us or our partners. Even partial use of images is not permitted without our express consent.

17. Warranty
Your warranty claims are based on the statutory provisions. The statutory warranty period is 24 months from receipt of the goods. We recognize the out-of-court arbitration board of the quality mark (www.guetezeichen.at) and the internet ombudsman (www.ombudsmann.at).

18. Applicable Law
For all legal transactions, the application of Austrian law is agreed, excluding the UN sales law.

19. Place of jurisdiction
If a customer is a consumer within the meaning of the KSchG, the court responsible for any legal disputes is the court in whose district the customer's domicile, habitual residence or place of employment is located. In all other cases, the competent court at the company location is agreed as the place of jurisdiction.
